Past performance, testimonials, case studies and examples do not guarantee that another client will obtain the same or similar results.
Nothing in this section excludes any guarantee, representation or remedy that cannot lawfully be excluded.
4. Search Engine Optimisation and Organic Visibility Disclaimer
SEO and search visibility are influenced by third-party search engines, their algorithms, competitors, website changes, technical infrastructure, content quality, backlinks, indexing decisions and other factors outside GDM’s complete control.
GDM may recommend and implement technical, on-page, off-page, local, international, content-related and other optimisation activities within the agreed scope.
However:
- Search engines may change their algorithms, ranking factors, indexing processes or policies without notice.
- Search engines may delay indexing, decline to index particular pages or change the visibility of existing pages.
- Competitors may undertake optimisation activities that affect relative rankings.
- Previously visible pages or keywords may lose visibility despite reasonable optimisation efforts.
- Search engine updates, manual actions, security issues, website migrations and changes made by the client or other service providers may affect results.
- GDM cannot guarantee permanent rankings, indexing, featured snippets, map placements, AI-generated search citations or other search visibility outcomes.
Where GDM identifies issues or recommends corrective action, implementation will depend on the applicable scope, available access, technical feasibility and client approval where required.
5. Paid Advertising and Advertising Platform Disclaimer
GDM may assist with the planning, creation, management, optimisation and reporting of paid advertising campaigns across platforms such as Google, Meta, LinkedIn and other advertising networks.
Advertising services remain subject to the relevant platform’s policies, eligibility requirements, review processes, auction systems, audience availability and technical limitations.
Unless otherwise agreed in writing:
- Advertising budgets paid to advertising platforms are separate from GDM’s service fees.
- Advertising spend, platform charges, taxes, third-party subscriptions, production costs and other external expenses are payable as specified in the relevant quotation or agreement.
- GDM does not control advertising platform approval decisions, account restrictions, suspensions, disapprovals, auction prices, delivery fluctuations or changes to available targeting options.
- Campaign forecasts and estimates are not guarantees of impressions, clicks, leads, conversions, sales or revenue.
- The client remains responsible for the legality, accuracy and substantiation of its products, services, offers, claims, prices and business representations.
- Additional work arising from account suspensions, policy violations, tracking changes, platform disputes or circumstances outside the agreed scope may require a separate quotation.
GDM does not represent that any advertisement will be approved or remain active for a particular period.
6. Website Development, Hosting and Technical Services
GDM may provide website development, application development, hosting-related services, SSL configuration, domain-related assistance, business email setup, integrations, analytics configuration and technical support.
Technical services depend on the specifications, access, infrastructure and third-party providers applicable to each project.
Unless expressly included in a written agreement:
- Website or application development does not automatically include unlimited future development, maintenance, hosting, technical support, content updates or security monitoring.
- Hosting, domain registration, SSL certificates, business email services, plugins, themes, software licences and other third-party services may be subject to separate renewal fees and provider-specific conditions.
- Features requiring payment gateways, APIs, messaging services, external databases or third-party software may depend on those providers’ availability, pricing, eligibility requirements and technical restrictions.
- No website or application can be represented as entirely immune from cyberattacks, vulnerabilities, service interruptions or unauthorised access.
- Backups, disaster recovery, uptime commitments, maintenance windows, response times and security obligations shall be determined by the relevant service agreement.
- Changes to third-party platforms, APIs, browsers, operating systems or software dependencies may require additional development or maintenance.
- Where the client supplies hosting, domain, software or infrastructure, GDM’s responsibility is limited to the services expressly agreed and legally applicable.
Any free hosting, SSL certificate, domain name, domain email account or other introductory benefit advertised with a package is subject to the stated duration, specifications, eligibility and renewal conditions. Any applicable renewal or replacement cost should be disclosed in the relevant quotation or package terms.
Clients should maintain appropriate copies of their business-critical data and ensure that any backup or recovery requirements are expressly agreed with the relevant provider.
7. Mobile Applications and Third-Party Integrations
Application development may include UI/UX design, database integration, user authentication, payment gateway integration, push notifications, APIs, analytics, automation and other features specified in the relevant proposal.
The availability and operation of these features may depend on third-party infrastructure and approval.
GDM does not independently control:

- External API availability, rate limits, pricing or deprecation.
- Push notification delivery by third-party services.
- Changes in mobile operating systems, device compatibility or app store requirements.
- Infrastructure, hosting, database or software services operated by external providers.
Any maintenance, support, feature updates, security updates, infrastructure charges, store account fees and ongoing operational costs shall be governed by the relevant written agreement.
The terms “advanced”, “secure”, “custom”, “unlimited integrations” or similar descriptions on a service page must be interpreted in the context of the applicable package, technical feasibility, usage limits and agreed scope. Such descriptions are not a representation of absolute security or unlimited third-party access.
8. Social Media, Scheduling and Automation Disclaimer
GDM may provide social media management, content publishing, scheduling, CRM integrations, messaging workflows, lead capture, automated email communication, comment or inbox workflows and related services.
These services may depend on third-party permissions, account access, API availability, platform rules and client-provided information.
GDM does not guarantee uninterrupted publishing, successful delivery of every message, continuous API availability, uninterrupted automation execution or error-free operation of every third-party integration.
Automated messages and workflows should be reviewed for accuracy, appropriate permissions, recipient expectations and compliance with applicable marketing, privacy and anti-spam requirements.
Unless otherwise agreed in writing, the client is responsible for ensuring that the contact lists, recipient permissions, offers, messages and business claims supplied for a campaign are lawful and accurate.
Clients should not use automation services to send unlawful, deceptive, unsolicited or otherwise prohibited communications.
Where a workflow processes personal data, the parties’ respective responsibilities shall be governed by applicable law, the Privacy Policy and any relevant data-processing or service agreement.
9. Google Business Profile, Listings and Reputation Management
GDM may assist with business profile setup, profile optimisation, local search visibility, listing management, review response processes and related services.
Third-party platforms independently determine eligibility, verification, listing visibility, content moderation, review publication, account restrictions and suspension decisions.
GDM does not guarantee verification, reinstatement, a particular map position, a specific number of reviews or the removal of legitimate negative reviews.
Clients must provide accurate business information and must not request or authorise fake reviews, fabricated testimonials, misleading representations or other prohibited conduct.
Any review management, reputation-related or listing service must comply with the applicable platform policies and relevant law.
10. Creative Work, Content and AI-Assisted Materials
GDM may create or assist in producing logos, graphics, videos, written content, advertising creatives, marketing materials, concepts and other deliverables.
Where AI-assisted tools, licensed assets, stock materials, third-party software or external production resources are used, the resulting deliverables may be subject to applicable licence conditions, usage restrictions or disclosure requirements.
Unless expressly agreed otherwise:
- Drafts, concepts, unused design options, working files, source files and project files are not automatically included in the final delivery.
- The rights transferred or licensed in completed deliverables are governed by the applicable written agreement and payment conditions.
- Client-provided assets remain subject to the rights and permissions applicable to those assets.
- Some third-party fonts, photographs, video clips, music, plugins and other licensed materials may have restrictions on transfer, resale, redistribution or modification.
- AI-assisted outputs may require human review for accuracy, originality, suitability, factual correctness and legal compliance.
GDM does not represent that every AI-assisted output is unique, copyrightable, free from third-party rights or suitable for every commercial use.
Where legally required or contractually agreed, appropriate disclosures and permissions must be obtained before publication or commercial distribution.
11. Client-Provided Information and Materials
Clients and prospective clients may supply business information, logos, images, photographs, videos, written material, customer lists, testimonials, product descriptions, claims and other materials for use in a project.
The person or organisation supplying those materials is responsible for ensuring that it has the necessary authority, permissions, licences, consents and other legal rights for the intended use.
Clients must not knowingly provide materials that:
- Infringe another person’s intellectual property or other legal rights.
- Contain unlawful, deceptive or materially misleading claims.
- Violate applicable privacy, confidentiality or publicity rights.
- Breach advertising, consumer protection, platform or industry-specific requirements.
- Contain malware or are intended to compromise systems or data.
GDM may request clarification, supporting evidence, revised content or additional authorisations where reasonably necessary.
GDM may decline, suspend or request the modification of work that it reasonably believes would violate applicable law, third-party rights, platform policies or contractual obligations.
This section does not remove GDM’s own legal responsibilities for work it creates or performs.
12. Intellectual Property and Website Content
Unless otherwise stated, the website’s original text, visual presentation, graphics, branding elements, design arrangements and other materials owned by GDM are protected by applicable intellectual property laws.
The GDM name, logo, branding, original website content and other proprietary materials may not be copied, reproduced, modified, distributed, republished or commercially exploited without appropriate permission, except where permitted by applicable law.
Nothing in this Legal Notice grants a general licence to use GDM’s intellectual property.
The intellectual property rights in client deliverables, commissioned work, source files, software, reusable components, third-party assets and licensed materials shall be determined by the applicable contract and the rights available to the relevant parties.
Third-party names, trademarks, logos, products and platform references appearing on the website belong to their respective owners. Their appearance does not necessarily imply sponsorship, endorsement, partnership or affiliation.
13. Testimonials, Portfolio and Case Studies
GDM may publish testimonials, client feedback, portfolio examples, case studies, project descriptions, performance statistics and other materials to illustrate its experience and work.
Such material is provided for informational purposes.
Individual experiences and project outcomes vary according to the circumstances, scope, market, budget, timing and other relevant factors.
Unless expressly stated and supported by appropriate evidence, published examples should not be interpreted as promises of identical outcomes for another client.
Client names, logos, images, quotations and identifiable project information should be used in accordance with applicable permissions, contractual commitments and legal requirements.
14. Accuracy of Website Information
GDM makes reasonable efforts to maintain accurate and useful website information. However, website content may contain typographical errors, outdated information, incomplete descriptions, technical inaccuracies or information that changes over time.
Service descriptions, package features, displayed prices, introductory benefits, availability and delivery estimates may be revised.
A website description does not override a binding written agreement, invoice or accepted quotation governing a specific project.
Before making a purchasing decision, visitors should confirm the applicable service scope, price, taxes, delivery timelines, renewal costs, exclusions and other material conditions with GDM.
Nothing in this section permits GDM to disregard a binding offer, an existing contract or any disclosure required by applicable law.
15. Third-Party Websites, Tools and Services
The website may contain links to third-party websites, platforms, software, tools, payment services, hosting providers or other external resources.
Such links are provided for convenience or informational purposes.
GDM does not control all external websites and is not responsible for their content, availability, security, policies, terms or subsequent changes.
Accessing a third-party service may subject you to that provider’s separate terms, privacy policy, licence conditions and payment obligations.
Users should review the applicable third-party documentation before submitting personal information, making payments, granting permissions or relying on an external service.
Nothing in this section excludes liability that GDM cannot lawfully exclude.
16. Security and Availability
GDM takes reasonable measures appropriate to its role and agreed responsibilities when providing its services. However, the internet, software systems and third-party infrastructure may be affected by technical failures, malicious activity, unauthorised access, service interruptions and other risks.
Unless a separate written agreement expressly provides otherwise, GDM does not warrant that the website or any service will be continuously available, uninterrupted, completely secure or entirely free of defects.
Visitors should not transmit confidential, sensitive or security-critical information through an unapproved channel.
Any incident involving client systems, credentials, personal data or infrastructure should be addressed in accordance with the applicable agreement, the parties’ respective responsibilities and applicable law.
17. Limitation of Liability
To the extent permitted by applicable law, GDM shall not be responsible for losses arising solely from matters outside its reasonable control, including independent third-party platform decisions, external service interruptions, search engine changes, client-supplied inaccuracies or unauthorised changes made by others.
Any limitation of liability applicable to a particular client engagement shall be determined by the relevant contract and applicable law.
Nothing in this Legal Notice is intended to exclude or restrict liability for fraud, wilful misconduct, liabilities that cannot lawfully be limited or any mandatory rights and remedies available to a consumer or other protected person.
Nothing in this section creates a limitation of liability where none would otherwise be legally enforceable.
18. Privacy and Personal Data
The collection, use, storage, disclosure and processing of personal data through GDM’s website and services are addressed in our separate Privacy Policy and any applicable contractual or data-processing terms.
GDM may process information necessary to respond to enquiries, communicate with clients, prepare proposals, provide services, manage business relationships, maintain records and fulfil legal obligations, subject to applicable law.
Where GDM processes personal data on behalf of a client, the parties must establish their respective responsibilities according to the nature of the processing, the relevant contract and applicable data protection law.
Visitors and clients should refer to the Privacy Policy for information concerning personal data, cookies and similar technologies where applicable, third-party service providers, retention, data-related requests and privacy contact details.

GDM and its clients must comply with the laws and regulations applicable to their respective activities.
Depending on the engagement, relevant requirements may include advertising standards, consumer protection, intellectual property, data protection, electronic communications, cybersecurity, taxation, industry-specific advertising restrictions and third-party platform policies.
The client remains responsible for obtaining licences, registrations, product approvals, professional authorisations and other permissions applicable to its business unless a specific responsibility is expressly assigned to GDM in writing.
GDM does not provide legal, tax, accounting, financial, medical or other regulated professional advice merely by providing marketing, creative, technical or consulting services.
Clients should obtain qualified professional advice where required for their particular business or industry.

Subject to applicable law and the jurisdiction of competent courts, disputes relating to this Legal Notice shall be brought before the competent courts in Bengaluru, Karnataka, India.
Any separate dispute resolution, arbitration, jurisdiction or governing-law provision contained in a binding client agreement shall be considered in accordance with that agreement and applicable law.
